BOOKING CONDITIONS
These Booking Conditions outline the terms under which you contract with Travel Sapphire Pty Ltd for arranging and delivering travel services for your trip. By making a booking, you confirm that you have read, understood, and agree to these terms. We reserve the right to amend these Booking Conditions at any time before you submit a booking request. “You” and “Your” refer to all individuals named in a booking (including those added or substituted later). “We,” “us,” “our,” and “Luxe Isles” refer to Luxe Isles Pvt Ltd.
BOOKINGS
A booking request is accepted when we issue a written confirmation and you pay your deposit. At this point, a contract between you and us is established, subject to these Booking Conditions. We reserve the right to decline any booking at our discretion. Only a director of Luxe Isles has the authority to modify these Booking Conditions or to offer any discounts or refunds.
SERVICES
We begin providing services as soon as we accept your booking, which includes substantial preparatory work for your travel arrangements. Our services are limited to (a) arranging and coordinating your travel plans and (b) delivering the travel arrangements we directly control.
PRICES & EXCLUSIONS
Prices are quoted in United States Dollar ($USD) and are current at the time of publication. For the latest pricing, please check our website. The price covers accommodation, transportation, and other inclusions specified in the itinerary. International airfares are not included unless explicitly stated. Additional costs for vaccinations, insurance, meals (unless specified), emergency evacuations, gratuities, and personal expenses are not included.
PRICE VARIATIONS
We reserve the right to adjust the cost of your travel arrangements prior to commencement due to factors beyond our control, such as fuel surcharges or changes in government fees. We also reserve the right to change prices due to currency fluctuations. However, once full payment is received, we will not increase the price for currency fluctuations, absorbing the first 2% of any negative changes.
DEPOSIT
A non-refundable deposit of $100 per person (or another amount communicated to you) is required within 7 days of booking acceptance. We cannot hold services until the deposit is paid, meaning that services may become unavailable or prices may increase, for which you will be responsible.
FINAL PAYMENT
Full payment is due no less than 30 days before the start of your travel arrangements. Some trips may require earlier or additional payments, which will be noted in your booking confirmation. If payment is not received by the due date, we will remind you, and you will be responsible for any supplier costs resulting from late payment. If payment is not received within 7 days of our reminder, your booking will be considered cancelled.
CANCELLATION BY YOU
You may cancel your booking by providing written notice to us. Refunds will be issued minus cancellation fees based on the following schedule, calculated from the date we receive your written notice:
60 days or more before commencement: Deposit only
59 to 31 days before commencement: Deposit plus 50% of the booking value, whichever is greater
30 days or less before commencement: 100% of the booking value
Note that some travel arrangements may incur higher cancellation charges, and a 100% cancellation fee may apply immediately after booking confirmation. We will inform you of any different charges prior to confirming services. These charges reflect a genuine pre-estimate of our losses at various cancellation points. For group bookings, transferring to another departure date is considered a cancellation of the original booking.
ILLNESS OR VACCINATION STATUS
If you are denied travel due to illness, suspected illness, or failure to meet vaccination requirements:
If you have already begun your trip, we will assist in arranging alternative travel at your cost.
If you have not yet commenced your trip, we cannot provide assistance.
We will not refund your trip costs, as we have already committed funds to suppliers and incurred preparatory costs. We recommend purchasing travel insurance that adequately covers cancellations due to illness and other unforeseen events as soon as you pay your deposit.
OTHER CANCELLATIONS
“Force Majeure” refers to events beyond our control that we could not have reasonably prevented, including but not limited to:
Natural disasters (flooding, fire, earthquakes, etc.)
Adverse weather conditions (hurricanes, cyclones)
War, armed conflict, industrial disputes, civil unrest, or terrorist threats
Epidemics or pandemics
Any changes in law or regulations from government authorities
Force Majeure
Prior to Travel
If we reasonably determine that your travel arrangements cannot safely proceed due to a Force Majeure event, or if you notify us within 14 days prior to travel that you cannot proceed due to Government Restrictions (e.g., border closures), we may:
Reschedule your travel arrangements, subject to your agreement; or
Cancel your travel arrangements, terminating our contract with you.
In the case of cancellation, neither party may claim damages. We will either:
Issue a credit equal to payments received, valid for 12 months; or
Provide a refund for cancelled arrangements, less:
Unrecoverable third-party costs,
Overhead charges,
Fair compensation for work completed up to cancellation.
Our ability to issue credits may depend on supplier cooperation. If not, we may provide a limited cash refund.
During Travel
If we cancel arrangements after your trip has started due to Force Majeure, we will refund only recovered third-party costs.
GENERAL
For limited cash refunds, we will attempt to recover payments from third parties but make no guarantees. If we recover funds after issuing a refund, we will pass them on to you.
We are not liable for any additional losses or costs (e.g., airfare, insurance) due to cancellations from Force Majeure. If you accept alternative services due to cancellations, the refund will be reduced by their value.
We strongly recommend purchasing travel insurance to cover cancellation and rescheduling risks.
OTHER CANCELLATION
If we cancel for reasons other than Force Majeure or failure to meet minimum numbers, you may choose a full refund or equivalent arrangements if available. We will not cover any additional expenses from such cancellations.
AMENDMENTS BY YOU
We will accommodate amendment requests as possible, but some may not be feasible. For group departures, changing dates is treated as a cancellation, incurring a $100 amendment fee plus any supplier costs.
AMENDMENTS BY US
Prior to Travel
Due to the travel industry’s dynamic nature, we may modify itineraries or inclusions. Most changes will be minor. If significant changes occur that materially detract from the trip’s value, we will notify you and refund the difference.
During Travel
You acknowledge that itineraries may change due to local conditions (e.g., weather, transport schedules).
General
To the fullest extent permitted by law:
We are not liable for omissions or modifications due to Force Majeure.
If you are entitled to compensation for modifications, it will be reduced by the value of any alternative services accepted.
We will not be liable for expenses or losses from itinerary changes.
Unused & Denied Services
No refunds will be issued for unused arrangements, whether by choice or due to delays. If you are not fully vaccinated against Covid-19 and denied services, you will not receive a refund. We are not liable for any resulting losses or expenses.
CLIENT NAMES
Names must match your passport exactly. Please provide a scanned copy; errors requiring re-issuance will incur fees.
GROUPS
Trips require a minimum of two fully paid travelers unless stated otherwise. If minimum numbers are not met, the trip may be cancelled or re-costed. You will be notified at least 60 days prior to departure and may choose to accept the new cost or cancel for a full refund.
TRAVEL INSURANCE
Comprehensive travel insurance is strongly recommended, covering cancellation, medical emergencies, and other expenses. Purchase insurance at the time of deposit due to potential cancellation fees.
ACCOMODATION
We may substitute accommodation with properties of comparable or higher quality. Such substitutions are not significant changes.
VACCINATIONS
We recommend full vaccination against Covid-19. It is your responsibility to obtain required vaccinations and preventative medicines.
HEALTH & FITNESS
Ensure you have the necessary health and fitness for your trip. Contact us if in doubt. Some trips may require a Self-Assessment Form, and your booking is contingent upon its completion.
MEDICAL CONDITIONS
Disclose any existing medical conditions when booking. Notify us of new conditions as well. Failure to disclose may result in cancellation and applicable fees.
DIETARY REQUIREMENTS
Notify us of special dietary requests within 7 days of booking confirmation. We will relay these requests but cannot guarantee fulfillment. Check meals for allergens.
INDEPENDANT SERVICES
We are not liable for activities not included in your itinerary. Recommendations from us or local representatives are based on known information and do not imply liability.
ACCEPTANCE OF RISK
You acknowledge the personal risks associated with travel and agree to consult DFAT guidance for your destinations.
RESPONSIBILITY
Independent Suppliers: Our obligations are limited to selecting reputable suppliers. We are not liable for their actions or omissions.
Directly Supplied Services: We will provide services with reasonable skill and care.
GENERAL LIABILITY LIMITATION
We do not guarantee our schedule and will not be liable for any missed connections or additional expenses due to delays. Compliance with local laws will be deemed proper performance.
COMPLAINTS
Notify us or our local supplier of any issues during travel to allow us the opportunity to resolve them. If unresolved, follow up in writing within 30 days after your travel.
DEEMED ACCEPTANCE
If booking on behalf of another, you represent that you are authorized to bind them to these conditions.
IMAGE RELEASE
We may take photographs or recordings during tours for promotional use. If you do not consent, please notify us at least 21 days prior to your tour.
GENERAL
This contract is governed by the laws of Maldives. Disputes shall be resolved in the appropriate court. If any provision is unenforceable, the remaining provisions will remain effective. Your personal information will be handled according to our Privacy Policy.
